These Terms of Service govern your use of hawaiianmovers.com and the shipping, freight forwarding, vehicle transport, and moving services provided by Hawaiian Movers Inc (“Hawaiian Movers,” “we,” “us,” or “our”). By using this website, requesting a quote, or booking a shipment, you agree to these terms.
Our Services
Hawaiian Movers arranges container shipping, less than container load (LCL) consolidation, vehicle transport, household goods moving, and related freight services to and from Hawaii, Guam, and the U.S. mainland. We arrange transportation with ocean carriers, truckers, and terminal operators. Where we act as an intermediary rather than the carrier, the carrier’s own bill of lading and tariff govern the movement of your goods.
Hawaiian Movers Inc is registered with the Federal Motor Carrier Safety Administration under USDOT 4024631 and MC 1518931. Where a shipment is arranged as ocean transportation rather than carried by us directly, the ocean carrier’s own bill of lading and tariff govern that movement.
Quotes and Estimates
Quotes are estimates based on the information you provide, including weight, volume, commodity, origin, destination, and requested dates. Quotes are valid for the period stated and are subject to change if:
- The actual weight, volume, or commodity differs from what you described.
- Carrier rates, fuel surcharges, or terminal fees change.
- Accessorial services are required, such as waiting time, redelivery, inside pickup, shuttle service, storage, or special handling.
- Access at pickup or delivery requires equipment or labor not included in the original quote.
Charges assessed by third parties, including port fees, customs examinations, demurrage, and detention, are passed through to you.
Booking and Payment
A booking is confirmed when we issue a written confirmation. Payment terms are stated on your quote or invoice. Unless we agree otherwise in writing, payment is due before release or delivery of your goods. We may hold cargo pending payment of amounts owed to us or to a carrier on your behalf, to the extent permitted by law.
Your Responsibilities
You agree that:
- All information you provide about the shipment, including contents, weight, and value, is complete and accurate.
- You are the owner of the goods or are authorized to ship them.
- Goods are packed adequately to withstand ocean transport, handling, and inland movement. Owner-packed containers and cartons are your responsibility.
- You have obtained any permits, licenses, or inspections required for the commodity, including agricultural clearance where applicable.
- You will be available, or will designate someone, to receive delivery at the scheduled time.
Prohibited and Restricted Items
You may not tender hazardous materials, explosives, flammables, compressed gases, ammunition, illegal substances, cash, jewelry, precious metals, securities, or live animals without our prior written agreement. Certain plants, produce, soil, and agricultural items are restricted by state and federal inspection rules. Perishable and temperature sensitive goods are shipped at your risk. We may refuse, hold, or dispose of any shipment found to contain prohibited items, and you remain responsible for resulting costs, fines, and penalties.
Transit Times
Sailing schedules, transit times, and delivery dates are estimates, not guarantees. Ocean transport is subject to vessel schedules, port congestion, weather, labor conditions, equipment availability, customs and agricultural inspection, and other factors outside our control. We are not liable for losses caused by delay unless we have agreed to a guaranteed date in writing.
Cargo Liability and Claims
Liability for loss of or damage to cargo is limited by the terms of the governing bill of lading, carrier tariff, and applicable law, which for ocean carriage to and from Hawaii and Guam may include the Carriage of Goods by Sea Act and, for interstate household goods movement, the released value provisions of federal law. Absent a written declaration of higher value and payment of the corresponding charge, liability is limited to the minimum amount allowed under the applicable rule.
Claims must be submitted in writing within the period stated in the governing bill of lading or tariff. Notice of visible loss or damage must be made at the time of delivery and noted on the delivery receipt. Concealed damage must be reported promptly. Failure to give timely notice may bar your claim.
Cargo Insurance
Carrier liability is not insurance and is frequently far less than the value of your goods. We strongly recommend purchasing separate cargo coverage. Where we arrange coverage on your behalf, the policy terms, exclusions, and deductibles of the issuing insurer apply.
Cancellation, Storage, and Detention
Cancellations may be subject to charges already incurred, including booking fees, equipment positioning, and trucking. If your shipment cannot be delivered as scheduled for reasons within your control, storage, demurrage, detention, and redelivery charges accrue to your account.
Force Majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including weather, natural disasters, port or terminal closures, labor disputes, vessel delays or omissions, government action, acts of war or terrorism, or public health emergencies.
Website Use
The content on this website, including text, images, and logos, is owned by Hawaiian Movers or its licensors and may not be copied or reused without permission. You agree not to use the site to transmit unlawful or harmful material, or to attempt to gain unauthorized access to our systems. Rate and schedule information on this site is for general reference and does not constitute a binding offer.
Disclaimer of Warranties
This website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the site will be uninterrupted or error free.
Limitation of Liability
To the fullest extent permitted by law, Hawaiian Movers is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of business, or loss of use, arising from our services or your use of this website, even if advised of the possibility of such damages. Nothing in this section limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Hawaiian Movers and its employees and agents from claims, fines, penalties, and expenses arising out of inaccurate shipment information, prohibited or undeclared items, your breach of these terms, or your violation of any law or regulation.
Governing Law and Disputes
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Disputes will be brought in the state or federal courts located in Los Angeles County, California, and you consent to that venue. Where federal transportation law applies to a cargo claim, that law controls.
Changes to These Terms
We may revise these terms from time to time. The effective date above shows when they were last updated. Continued use of our website or services after a change means you accept the revised terms.
